Hiring a Web Development Team in India from Canada

Hiring web developers in India from Canada: the time difference by province, PIPEDA rules for customer data, written copyright transfer and how to invoice.

Hiring a Web Development Team in India from Canada

Introduction

Yes, a Canadian business can hire a web development team in India and get a good result, provided three things are agreed before any code is written: a written scope, a feedback routine built around the time difference, and a contract that hands you the code, the copyright and every account. India is between eight and twelve and a half hours ahead of Canada, so work moves forward while you sleep.

This guide covers what that time difference means for each part of Canada, what Canadian privacy law expects when an overseas team touches customer data, why copyright needs a signed document under Canadian law, and how to set up payments and invoices so nothing is left vague.

What time is it in India during your working day?

India runs on India Standard Time (UTC+5:30) all year and has no daylight saving clock changes, according to timeanddate's page on India's time zone. Canada is spread across six standard time zones, each with a daylight saving version, and several areas such as most of Saskatchewan and Yukon don't change their clocks, as timeanddate's guide to Canadian time zones explains. The offsets below are the ones in use during Canadian daylight saving time, which in 2026 runs until 1 November.

How far ahead India is, during Canadian daylight saving time
CityTime zone in useUTC offsetIndia is ahead by9:00 am local is, in India

Regina, Edmonton, CalgaryCentral Standard / Mountain Daylight TimeUTC-611 hours 30 minutes8:30 pm
Vancouver, WhitehorsePacific Daylight / Mountain Standard TimeUTC-712 hours 30 minutes9:30 pm

When daylight saving ends, the gap grows by an hour for places that change their clocks. Eastern Time moves to UTC-5, Atlantic Time to UTC-4, Central Time to UTC-6 and Mountain Time to UTC-7, and Newfoundland goes to UTC-3:30, per the same timeanddate page. Toronto is then ten and a half hours behind India. Regina and Whitehorse stay where they are. If you're in British Columbia, check the winter offset on that page before you fix a meeting slot for November onwards.

How do you work with a ten-hour gap without slowing down?

The gap helps if you plan for it. Your morning is the Indian team's evening, so a short call at the start of your day can review what they built while you were asleep. Anything you send by the end of your day is waiting for them when they start, and the reply is usually there when you open your laptop.

  • Put feedback in writing. A list of comments with screenshots, in a shared tracker, beats a long call. Nobody has to remember what was said at 7 pm IST.
  • Agree one overlap slot. For Eastern Time, early morning works best. For Alberta and British Columbia, the overlap is thin, so a fixed weekly call plus written updates on the other days is more realistic.
  • Use a staging site. You should be able to click through the latest version on a private link at any time, not wait for a screen share.
  • Name one decision-maker on your side. Two people giving different answers costs a full day each time, because the question waits overnight.

What does PIPEDA say about an overseas team handling customer data?

Canada's federal private-sector privacy law, PIPEDA, does not stop you sending personal information to a company outside Canada for processing. The Office of the Privacy Commissioner's guidelines on processing personal data across borders say that PIPEDA takes an organisation-to-organisation approach, that a transfer for processing counts as a "use" rather than a disclosure, and that you stay accountable for the information while the other company holds it.

In practice, the guidelines point to four things:

  1. A contract. The OPC says the main way to protect data with a processor is by contract, giving a comparable level of protection to what it would have in Canada.
  2. Checks on the supplier. You should be satisfied the team has policies, staff training and security measures in place, and you should have the right to audit how they handle the data.
  3. A risk assessment. No contract can override the laws of the country where the data is processed, so think about how sensitive the data is before it leaves Canada.
  4. Transparency. Your customers should be told, in clear language, that their information may be processed in another country and may be accessible to that country's courts and authorities.

The easiest way to keep this simple for a website project is to give the developers no real customer data at all. Build and test with dummy orders and dummy accounts, and give production access only to the person who deploys. The OPC also notes that its guidelines don't cover provincial private-sector privacy laws, so if your province has its own, check that as well.

Who owns the code and design under Canadian law?

Under section 13 of Canada's Copyright Act, the author of a work is the first owner of its copyright, unless the work was made by an employee in the course of their employment. An outside agency is not your employee. The same section says an assignment of copyright is only valid if it is in writing and signed by the owner or their authorised agent.

So a paid invoice alone does not transfer ownership. Your contract should include a signed clause assigning the copyright in the custom code, design files and content to your business once each milestone is paid. Section 14.1 of the Act adds that moral rights can't be assigned but can be waived, so ask for a written waiver too. Open-source libraries and themes stay under their own licences, which is normal; the contract should list them.

Beyond copyright, make sure these are in your name from day one:

  • the domain registration and DNS
  • the hosting or cloud account, with the developers added as users
  • the code repository
  • analytics, Search Console and any payment gateway accounts

How should payment and invoicing work?

Agree the currency, the milestones and the payment method in the contract, before work starts. A typical structure ties each invoice to a deliverable you can see on the staging site, such as approved designs, a working build and the launch, rather than to hours logged.

  • Currency. Decide whether invoices are in Canadian or US dollars so neither side argues about exchange rates later.
  • Invoice details. Each invoice should show the supplier's legal name and address, your business name, the milestone, the date and the payment terms.
  • Payment method. International bank transfer is the usual route; agree in writing who covers bank charges.
  • Tax. How GST/HST applies to services you buy from outside Canada depends on your registration and how you use them, so ask your accountant once, before the first invoice, and keep their answer on file.

What should the scope document include?

A fixed quote is only as good as the scope behind it. Before you sign, get a document that lists every page or template, every feature, the integrations (payment gateway, booking tool, CRM), who supplies the content, the browsers and devices it will be tested on, and what counts as "done". Anything not written down is a change request, so it's worth an extra day here.

If you're replacing an existing site, add the redirect plan to the scope. Our website migration checklist covers what to keep so search traffic isn't thrown away at launch.

When is an Indian team the wrong choice?

Be honest about the cases where it won't suit you. If you need people in your office every week, or you can only give feedback through long live calls, a local team will be easier. The same goes if your data can't leave Canada under a client contract or a sector rule. For most small and mid-sized business websites, online stores and web apps, none of these applies, and a remote team with a clear routine works well.

Frequently asked questions

Is it legal for a Canadian business to hire a web developer in India?

Yes. PIPEDA does not prohibit sending personal information to an organisation in another country for processing, according to the Privacy Commissioner's cross-border guidelines. You remain accountable for that data, so use a contract and keep real customer data out of development where you can.

What is the time difference between Toronto and India?

During Eastern Daylight Time, India is 9 hours 30 minutes ahead of Toronto, so 9:00 am in Toronto is 6:30 pm in India. When Toronto moves back to Eastern Standard Time (UTC-5), the gap becomes 10 hours 30 minutes.

Do I own the website code if I pay for it?

Not automatically. Under section 13 of the Copyright Act, an assignment of copyright is only valid in writing and signed by the owner, so make sure your contract includes a signed assignment and a waiver of moral rights.

How do I stay in control of the project?

Keep the domain, hosting, repository and analytics accounts in your business's name, review progress on a staging link, and pay against milestones you can see working. That way you can change suppliers at any point without losing anything.

Conclusion

For a Canadian business that is happy to give feedback in writing, keeps customer data out of the development environment and gets the copyright assigned in a signed document, an Indian team is a practical choice, and the time difference means work moves forward overnight. If you need people on site or your data must stay in Canada, hire locally.
