Introduction
Yes, a German business can hire web developers in India and get a good result, as long as three things are settled before any code is written: a written scope, a feedback routine built around a time gap of three and a half to four and a half hours, and a contract that covers personal data, ownership of the code and every account. India is ahead of Germany all year, so your morning is the Indian team's afternoon and there is a real overlap every working day.
This guide covers what the time difference looks like across the year, why GDPR transfers to India need a safeguard such as the EU's standard contractual clauses, what to put in the contract, and how to set up payments and invoices. It is practical advice from a team that builds websites for overseas clients remotely from India, not legal or tax advice.
What time is it in India during your German working day?
Germany has a single time zone. It uses Central European Time (CET, UTC+1) as standard time and Central European Summer Time (CEST, UTC+2) while daylight saving is in force, with the next switch to summer time on 28 March 2027, according to timeanddate's page on Germany's time zone. India does not change its clocks. On timeanddate's time difference table for Berlin, New Delhi is shown 4 hours 30 minutes ahead while Germany is on winter time, and it is not marked as adjusted for daylight saving. When Germany moves its clocks forward an hour in summer, the gap shrinks to 3 hours 30 minutes.
| Time in Germany | India time, German winter (CET) | India time, German summer (CEST) |
|---|---|---|
| 09:00 | 13:30 | 12:30 |
| 11:00 | 15:30 | 14:30 |
| 13:00 | 17:30 | 16:30 |
| 15:00 | 19:30 | 18:30 |
Put simply, a German morning overlaps with the Indian afternoon. That is a much easier setup than hiring from North America, where the two working days barely touch.
How do you run a project across a four-hour gap?
The overlap is short but dependable, so use it for decisions and leave the building to the rest of the day.
- Book one fixed call slot. 09:30 or 10:00 in Germany falls in the Indian early afternoon all year. Keep it to 20 or 30 minutes and only for things that need a conversation.
- Give feedback in writing. One shared document or ticket board, with screenshots and a clear "approved" or "change this" on each item. Written feedback can be acted on the same afternoon in India without waiting for a call.
- Ask for a short end-of-day update. What was done, what is blocked, and which question needs your answer. It arrives in your late afternoon, so you can reply before you log off.
- Agree on a staging link. You should be able to click through the work in progress at any time instead of waiting for a demo.
We wrote about the same routine for a bigger gap in our guide to hiring a web development team in India from Canada, and most of it carries over.
Can an Indian team handle your customers' data under GDPR?
It can, but not by default. Under Article 45 of the GDPR the European Commission decides which non-EU countries offer an adequate level of data protection, and data can flow to those countries without any further safeguard. India is not on the Commission's list of adequacy decisions, which currently covers countries such as Japan, Switzerland, the United Kingdom and Brazil.
So if your Indian developers will access personal data, such as customer accounts, orders or contact form entries, the transfer needs another legal basis. The usual one for a business is the Commission's standard contractual clauses (SCCs). The Commission issued modernised SCCs on 4 June 2021 for transfers from controllers or processors in the EU/EEA to controllers or processors outside it, and it publishes questions and answers on how to use them.
In practice, two steps cut the risk a lot:
- Keep live customer data out of development. Most website work can be done on a staging copy with test or anonymised data. If the developers never see real personal data, there is far less to transfer.
- Put the data terms in writing before access is given. If access to live data is unavoidable, for example to fix a checkout problem, sign the SCCs and a processing agreement first, and give access through named accounts that you can switch off later.
Ask your Datenschutzbeauftragter or a data protection lawyer which SCC module fits your case and whether you need a transfer impact assessment. Our website security checklist covers the access side: named logins, two-factor authentication and removing old accounts.
Who owns the code, the design and the accounts?
Settle this in the contract, not at the end of the project. The points we would want in writing as a client are:
- The domain, hosting, payment gateway, analytics and email accounts are registered in your company's name, with the developers added as users.
- The source code lives in a repository your company owns, and the full code is handed over at each milestone, not only at the end.
- The contract states clearly what rights you get in the code, the design files and any content written for you, and that third-party themes, plugins and fonts are licensed in your name.
Copyright rules differ from country to country, so have a German lawyer check the wording of the rights clause rather than reusing a template written for another country.

How should payment and invoicing work?
Keep the money side boring and written down:
- A fixed written quote tied to the scope document, with the currency stated (euros or Indian rupees) so nobody argues about exchange rates later.
- Milestone payments linked to things you can check on the staging link, such as approved design, working checkout and launch.
- Invoices addressed to your company with your full legal name, address and VAT ID if you have one, the supplier's full details, a clear description of the service and the milestone it covers.
- Bank transfer details agreed once at the start and confirmed by phone or video call if they ever change, to avoid invoice fraud.
How a service invoice from an Indian supplier is treated for German VAT and in your books is a question for your Steuerberater. Send them a sample invoice before the first payment so any changes are made early.
What should the scope document include?
A good scope is what makes a remote project predictable. Before any work starts, it should list:
- Every page and template, and what goes on each one.
- Languages (German only, or German and English) and who writes or translates the text.
- Features such as booking, checkout, payment methods, newsletter signup and integrations with your existing tools.
- Legal pages you will supply, such as Impressum, privacy policy and cookie settings, and who is responsible for their content.
- Browsers and devices to test on, speed targets, and what "done" means for each milestone.
- What happens after launch: bug fixes, updates and who to contact.

When is an Indian team the wrong choice?
Be honest about this before you start. Hire locally if you need someone in your office or at your premises, if your contracts or customers require that personal data is never accessed from outside the EU, or if nobody on your side has time to give written feedback each week. Remote work runs on clear decisions from the client, and no time zone overlap can replace that.
Frequently asked questions
How many hours ahead is India compared with Germany?
India is 4 hours 30 minutes ahead while Germany is on winter time (CET) and 3 hours 30 minutes ahead while Germany is on summer time (CEST). India does not use daylight saving time, so the gap only changes when Germany changes its clocks.
Is India covered by an EU adequacy decision?
No. India is not on the European Commission's list of countries with an adequacy decision. If an Indian team will access personal data from your business, the transfer needs a safeguard such as the Commission's standard contractual clauses.
Can we work in German?
Ask your team directly and test it in the first call. Many projects run in English between client and developers, with the German website text written or checked by a native speaker on your side or by a translator you trust.
Do we need a lawyer or Steuerberater for this?
For the data protection terms and the rights clause, a German lawyer is worth the time. For VAT treatment and bookkeeping of foreign service invoices, ask your Steuerberater. A good development team will happily work with whatever contract your advisers prepare.
Conclusion
For a German business that gives feedback in writing, keeps live customer data out of development and puts data protection terms, ownership and invoicing in the contract, an Indian team is a practical choice, and the daily overlap with the Indian afternoon makes communication easier than most people expect. If your data must never be accessed from outside the EU or you need people on site, hire locally.
